Terms and Conditions for Motorcycle Use
The following "terms and conditions" are related to the use of a motorcycle owned by Peter & Friends Classic Adventures® Pvt. Ltd. (India ).
Documentation Documentation should include a valid two wheeler license, a valid International driver's license, and adequate insurance coverage for the duration of the tour. All necessary documents, which also include passport and the original motorcycle registration papers, should be carried on the person at all times.
Maintenance The bike users are responsible for daily bike functional check. The participant is liable for any subsequent damage due to negligence to perform daily oil, battery water and all other functional checks. Observed defects, or any hint of possible defects, should be reported at once to the next available authorized mechanic station and get fixed under the supervision of the bike user ad against a legal invoice. Traffic & Driving Every driver, even though following traffic rules, is responsible for his/her safe driving, the careful handling of the vehicle for his or her own safety as well as that of the other drivers and innocent bystanders. The undersigned considers himself informed of Indian traffic regulations as well as the actual unorthodox traffic situation, and the technical limitations of the Enfield Bullet, i.e.: weak brakes, reversed gear and brake levers.
Insurance The comprehensive motorcycle insurance for the Enfield Bullet limits personal indemnity to the driver to € 500 for each claim. Out-of-court settlements are highly recommended for third party claims as court and police procedures are notoriously slow and ineffective , and normally share out the blame to the different parties disregarding actual facts. An out-of-court settlement saves on time, bribes, and eventual tour extension costs. An out-of-court settlement automatically excludes any compensation from the part of the insurance company. The final arbiter in any such situation is the bike user. All costs relating to injury and hospitalization, and any expenses subsequently arising, such as tour extension, hotel bookings, motorcycle transport costs, are to be borne by the bike user and his personal travel insurance.
Deposit The bike user is expected to make a deposit of € 500 in cash or in traveler checks and to deposit his/her international flight ticket to the station manager for period of the use of the motorcycle. This deposits will be reimbursed at the conclusion of the period of use of the bike. This amount also corresponds to the personal indemnity ceiling of the Enfield Bullet insurance policy, as well as the ceiling the agency sets for damages incurred on the vehicle in an out-of-court settlement. There are different regulations for one way rentals.
Theft The motorcycles are insured against theft, but not the personal luggage of the participant. Every bike user is responsible for the safety of his/her own luggage. When the vehicle is stationary, the driver should remember to take all the keys with him and to lock the bike proper. At night, the motorcycles are to be kept within a guarded hotel compound etc..discuss with the tour guide beforehand his intended whereabouts.
Since September 2006 we are the first fully licenced rental station for Enfield 500cc Bikes in Goa. All our bikes are registered with yellow Z or T number, all bikes are insured for the purpose of bike rental.
The undersigned agrees to the above . Each bike user is aware of the risks of motorcycling without a helmet or protective clothing. The undersigned waives the right to lay any blame onto the agency for any eventual road accident.
